What to Do if You Are Arrested in NYC?
Getting arrested is a terrifying experience. The police are trained to make you feel isolated and powerless to get you to talk. The most important thing you can do is remain silent.
1. Do Not Resis: Even if the arrest is unlawful, resisting will only add new charges (Assault, Obstruction). Fight the arrest in court, not on the street.
2. Ask for a Lawyer: Clearly state, "I want to remain silent and I want to speak to my attorney." Then stop talking.
3. Do Not Consent to Searches: Police may search you anyway, but do not give them verbal permission.
4. Call Us Immediately: Once you are allowed a phone call at the precinct, call Sterling & Vance LLP at (718) 555-0199. We will show up at the arraignment to argue for your release.
